But in the UK, hacking is illegal so surely there would be some rights there?!?!

The burden of proof would be on your to prove someone did it; you've probably got no access to logs as this was a long time ago; the police have better things to do than worry about a Windows Live account; the police know nothing about computers; and the person who did it is probably abroad, so you have no jurisdiction over them.
